30.04.15 ECJ provides clarity on redundancy and collective consultation

The European Court of Justice (ECJ) has ruled that ‘establishment’ for the purposes of collective consultation when planning to make 20 or more staff redundant within a 90 day period means a ‘single site’ or workplace (School or Academy) and not the entire workforce of that employer, who may be spread across multiple sites.  This means that the Regulations regarding collective consultation and certain timescales needed for this will not apply if your School or Academy is making fewer than 20 redundancies.  Please however note that your School or Academy will have adopted a Redundancy Policy or Procedure that is likely to include a specific reference to the length of consultation required regarding any proposed redundancies, regardless of the number of staff involved.
